Negligence

Failure to exercise the level of care that a reasonable person would have under similar circumstances, resulting in harm to others. Proof of negligence requires four elements: duty, breach, causation, and damages. The victim must show:

• The defendant had a duty of care to the victim.
• The defendant breached the duty of care.
• The breach caused injuries to the victim.
